We accept personal injury, tort and workers compensation cases in Kentucky, and will evaluate each case on its own merits.  In most cases we handle these cases on a contingency basis.  But there are certain cases when structure an hourly fee arrangement in conjunction with a contingency fee.

In certain situations we can work on cases in states other than Kentucky with local counsel or enter as an out of state attorney pursuant to the particular state’s, bar code,  rules of ethics and civil procedure.  

The value of non-workers compensation injury cases, called torts, is usually based upon the severity of the injury, the amount of lost and potential lost wages, and pain and suffering.  Our legal fee is 33% of any recovery received prior to trial, 37% of any recovery received after the commencement of a trial, and 43% of any recovery received on appeal, which does not include costs and expenses incurred in the case.  We reserve the right to adjust these fees based upon the complexity of the case.

In workers compensation cases, the value of the case is based upon the nature of the injury, the injured party’s ability to return to work, and the injured party’s wages at the time of the injury.  There are other factors that may reduce or increase the value of a case.  The legal fees in workers compensation cases in Kentucky are set by statute, and are set forth in our engagement contract.
